Functions
Chief Secretary
The Chief secretary performs the general management of the administration as he/she:
1. is in charge of the execution of the assigned tasks due to the decisions of the commission and due to the orders of the Chairman;
2. gives assistance to the Chairman and the members of the commission in the performance of their powers;
3. organizes the work of the commission;
4. organizes the execution of the commission’s resolutions and the control over their performance;
5. coordinates the tasks distribution to be performed between the administrative levels and controls being in conformity with the deadlines on their execution;
6. organizes and is in charge for the preparation of draft internal acts of the commission;
7. coordinates and controls the activities concerning the training and raising the qualification of the employees;
8. establishes the job characteristics of the employees;
9. organizes, coordinates and controls the activities on attesting the state employees on behalf of the administration;
10. organizes holding sessions and makes up draft agenda for the regular sessions.
11. performs other tasks assigned by the Commission and the chairman.
Financial controller, internal auditor,
officer on the information security
The financial controller is appointed according the Law for financial management and control in the public sector and is directly subordinated to the Chairman of the Commission;
The financial controller:
1. executes his activity in conformity with the Directions for execution of preliminary control, issued by the Ministry of Finance, upon the application of the Law for financial management and control in the public sector and the accepted internal rules on the financial management and control in the Commission for Data Protection;
2. executes preliminary control on the legitimacy of the undertaken obligations and the expenditures incurred by the commission.
The internal auditor is directly subordinated to the chairman of the commission and performs internal audit according to the Law for Internal Audit in the public sector. The internal auditor performs his activity on all structures, programmes, activities and processes in the commission and its administration in conformity with article 13 of the law for internal audit in the public sector.
The internal auditor reports directly to the Chairman of the Commission.
The officer on the security of the information could be the Chairman of the omission or officer appointed by the Chairman of the Commission. The officer on information security performs the functions due to the Law for protection of the classified information and the Regulation for the application of the law for protection of classified information.
General administration
Directorate “Resource management”:
1. organizes and performs financial-accounting activities of the commission in conformity with the requirements of the Accountancy Law, the account plan of the budget enterprises, accounting standards and directions;
2. prepares and gives reason for draft of annual budget and organizes the development of three year budget forecast;
3. prepares monthly allocation of the established annual budget according to economic elements of the Uniform budget classification;
4. organizes, prepares and presents monthly inquiry for ensuring limit of payments of the commission in conformity with the Law for state budget of the Republic of Bulgaria for the corresponding year;
5. looks after the effective spending of the budget funding according to the released limits in conformity with the financial discipline;
6. suggests and prepares correction upon the established annual budget of the commission;
7. summarizes the data and prepares monthly, quarterly and annual accounts for the cash execution of the commission’s budget;
8. executes the accounting reporting in conformity with the regulations and the indications as it forms the primary and secondary accounting documents and reflects them in timely manner in the accounting registers. Prepares monthly and annual turnover registers;
9. prepares annual financial account of the commission;
10. applies the system for double signing when it comes to undertaking the obligations and expenditures incurring;
11. stores the accounting documents according to the requirements of the Accountancy Law and the internal rules and instructions;
12. supports the chairman on the human resource management;
13. prepares and updates the titles and namely schedule of the commission and its administration;
14. assists the preparation of individual job characteristics of the administration of the commission and presents them to the chief secretary for verification;
15. prepares, updates and stores the ex officio and labour dossiers of the employees of the administration;
16. organizes and is in charge for the preparation of the acts in connection with the occurrence, amendment and termination of the ex officio and labour legal relations;
17. prepares and sends in the statutory term the notifications to the territorial department of the National Revenues Agency on the occurrence, amendment and termination of the legal relations with the employees of the Commission;
18. plans and supports the organization on the training of the employees to the aim of raising their qualification and their career development;
19. prepares statistical inquiries on the salary and the movement of human resources in the commission, prepares all certifying documents of the employees concerning the ex officio and labour legal relation;
20. organizes the management and the exploitation of the buildings;
21. prepares the draft-documents on the assignation of public tenders, participates in the performance of the procedures and organizes the activity on the preparation and storage of the dossiers of the finished public tenders.
22. executes the procedures representation on lawsuits concerned with the ex officio and labour legal relations, management of the proprietorship of the commission and upon the Law for public tenders and supplies information to the commission on their movement;
23. prepares draft-ordinances for the execution of the orders of the chairman of the commission;
24. participates in the preparation and entering of contracts upon which the commission is party;
Directorate “Administrative servicing” ensures the administrative and technical servicing of the commission and its administration as it:
1. organizes and maintains the clerk activity according to the effective legislation and the internal acts;
2. organizes and ensures the archive of the commission;
3. organizes and executes the movement of the correspondence that contains classified information and its archiving;
4. ensures and prepares the technical materials for the sessions of the commission and the accepted acts;
5. executes the connections of the commission with the media after preliminary coordination with the chairman of the commission;
6. organizes briefings, press conferences, meetings and seminars;
7. analyzes the publications in the media concerning the activity of the commission and informs on daily basis the chairman and the members of the commission;
8. organizes the performance of translations of materials concerning the activity of the commission;
9. executes the protocol activity of the commission and its administration in the country and abroad and ensures the thorough logistics on holding seminars, work meetings and other events;
10. ensures the transportation servicing of the commission and its administration;
11. performs the activity upon exploitation, repair works and maintenance of the auto-transportation technics in the commission;
12. organizes and controls the security and the checkpoint regime in the building of the commission;
13. ensures the defence-mobilizing preparation in the commission;
14. ensures the preparation and the actions of the commission in extraordinary cases, natural disasters, wrecks and crises.
Specialized administration
Directorate “Legal and international activity”:
1. supports the commission with legal consultations and standings on the application of the legislation in the area of the data protection, which is applicable in the country, in the European union and in third countries;
2. participation in the preparation or individually prepares drafts of regulations, internal acts and documents;
3. prepares legal standing on drafts of regulations that were received for coordination or expressing standing;
4. preparation of legal statements on inquiries by third parties on the application of the LPPD and requests on chapter sixth of the LPPD;
5. gives its statements on the request of directorate “Informational funds and systems” concerning the registration of controllers of personal data;
6. maintains data base with the acts of the European union and documents of institutions in the area of personal data protection;
7. prepares plans for the international activity of the commission;
8. participates in programs in the framework of the international cooperation, on forums in the country and abroad, prepares and organizes materials for participation of the commission and its administration in these events;
9. prepares statements of the commission on drafts of international documents; prepares and executes notification of the commission on the work with the international organizations;
10. participates in the preparation and the realization of drafts for bilateral and multilateral agreements in the area of the personal data protection;
11. participates in the preparation of suggestions for participation in projects and programmes with national and international funding, research, preparation and coordination of the project documentation as it follows the established procedures; executes cooperation in the process of monitoring on the programmes;
12. maintains operative contacts of the commission with the national and international institutions that concern the actual activities of the commission;
13. organizes and executes the training in the area of the personal data protection;
14. analyzes the results of the application of the regulations and the international contracts in the area of personal data protection and supplies statements on the necessity of undertaking the corresponding national measures;
15. analyzes the experience and work of the international organizations and institutions and the foreign legislation, executes research work on issues of international nature and maintains library of the acts and the court practice concerning the activity of the directorate.
Directorate "Legal procedures and supervision" assists the commission in executing the activities upon article 28, paragraph 1, point 1, point 5 and point 6, as it:
1. researches the incoming petitions and prepares motivation legal statements on the admissibility and the reasonable nature;
2. prepares drafts of resolutions that are supplied with arguments in their support;
3. executes the control activity of the commission;
4. executes the procedure representation in front of the court against acts of the commission and supplies current information to the commission on the status of the lawsuits;
5. prepares statements, reports, conclusive acts, drafts of mandatory directions and of penalty provisions;
6. prepares and offers for approval by the commission methodics for the application of the LPPD and the rules for the execution of the legal procedures and supervision;
7. analyses and summarizes the practice of the commission and supplies statements on the general state of the system for the personal data protection in the area of the legal procedures and surveillance;
8. maintains registers of the incoming petitions, the issued penalty decrees, the prepared conclusive acts and the issued mandatory directions;
9. enforces according to the order of the tax-insurance procedure code the entered into effect resolutions of the commission and the issued penalty decrees on setting real sanctions and fines;
10. participates in work groups, expert councils and other events of the commission.
Directorate "Informational funds and systems”:
1. builds and organizes keeping of the register of controllers of personal data and the registers kept by them;
2. preparing justified statements on incoming excerpts that are of the competency of the commission;
3. prepares justified statements on entering, refusal for entering in the register according to point 1 as well as releasing from the obligation for registration of controllers of personal data;
4. executes the activity of the commission according to article 28, paragraph 1, point 2;
5. maintains the notifications upon article 25, paragraph 1, point 2 and the resolutions upon article 25, paragraph 4 of LPPD.
6. builds and maintains the integrated communication-informational system of the commission
7. executes the automated data exchange with national and international informational systems;
8. maintains and updates the webpage of the commission;
9. prepares for publishing bulletin of the commission in which there is published information on its activity and the decisions made;
10. investigates and applies state-of-art informational and communicational technologies;
11. maintains Centre for information and contacts of the Commission;
12. analyzes the incoming inquiries and presents in front of the commission monthly report with summaries and suggestions on the current practice of the Centre for information and contacts.
